First: the obligations of the processor:
Committed to the processor as follows:
1-Supplying of new energy grains vacuum pumps ability to pump of 300 tons / hour (QTY. / 2) new and unused with Stand-by materials of (10%) ten per cent from the value of the contract for Om Qasr Port according to the required specifications and from a well known and certified origin. Prices must be fixed in the supplier’s tender; the supplier also has to guarantee the good and safety arrival of materials to the Public Company of Iraq Ports’ stores – Basra – Om Qasr and without any damage or shortage according to prices of contract. If there is any shortage, damage, or bad materials; the Public Company of Iraq Ports then has the right to reject it and the supplier will be responsible about returning or exchanging them during the specified period in item no. (First – 4) and the supplier will be according to the CIF of Basra / Om Qasr.
2-Freight provider bears all the tender items from origin to the company's stores / Om Qasr as a final destination; he also bears the whole fees and taxes.
3-Provide certificates of origin and trade lists of the company duly certified manufacturer of Iraqi commercial ancillaries abroad prior to the entry of goods imported into Iraq, and two copies, accompanied with shipping documents.
4-Supplying must be processed during the period (180) days from the date of service of the Bank of the processor to open a documentary credit and non-proven Irrevocably by the General Company for Iraqi Ports, including the name of the processor is equivalent to the amount of the contract by the Trade Bank of Iraq and called the amount of documentary credit only with the consent of the General Company for Ports of Iraq after access to materials and delivery to warehouses in accordance with the specifications and requirements.
5-Submit a separate tender portions, one technical and one commercial (the price by U.S. $).
6-In the case of sea freight on the basis of CIF / Basra, Om Qasr will be shipped through the ports of Iraq.
7-Submit the original bills of lading of fundamentalism during a maximum period (15 days) from the date of shipment of materials already provide those documents to hand over the goods to the order of the General Company for Ports of Iraq and not exclusively by the processor to issue any instructions or guidance to deliver the goods to non-public company for the ports of Iraq during the transfer of place of shipment to the place of delivery.
8-Materials to be processed in conformity with the requirements and specifications set by the General Company for Ports of Iraq and established contract with the supplier.
9-The guarantee period (maintenance) for a period of one year beginning on the date following the issuance of a certificate of receipt issued by the Commission supports the successful passing of the tender conditions and technical specifications which will be required during which the processor is responsible for the maintenance, repair and replacement of affected material and not suitable for work at his own expense and is not entitled to refer it to any amounts or compensation as a result, in the case of non-implementation of the General Company for Ports of work and the amounts deducted from the amount reserved in the case of insufficient amount of processor demanding compensation from the company any amounts have as a result.
10-Not installed any comments or reservations, or in the tender offer in violation of these conditions and when installed excluded from the tender bidding.
11-May not be equipped to adhere to emergency circumstances, force majeure, which occur during the processing time and is responsible for the damage caused to the company.
12-Compliance with the restrictions of the numbers of processed materials, in the case of change of the figures cited by the manufacturer to prove it to highlight the company's certificate of the same.
13-Provider is committed to pay for the loads to the management company when the company's implementation of its obligations by 20% of the actual cost of the implementation of the commitment.
14-The insurance provider of the goods must be comprehensive insurance for all risks.
15-Include bills of lading the goods are delivered to the order of the General Company for Ports of Iraq as the exclusive supplier undertakes not to issue instructions and guidance to deliver the goods to non-State Company for Iraqi Ports during the transfer of freight from shipping place to place of delivery.
16-The contractor is committed to the training of cadres of technical personnel from the company at his own expense and in the country of origin as follows:
•2 Mechanical Maintenance Technicians.
•2 Electrical maintenance technicians.
•2 Operator mechanisms.
17-Submit the name of the bank that deals with the first party within seven days from the date of signing the contract to facilitate the procedures for opening documentary credits for the other party. ■
